Hi, I have a problem, but I can't seem to find any Info on it. I hope someone on here can help.... My wife and I Applied for and Received Our Residency Last Year, and we Rented a Property with the Hope of Buying our own Villa soon. We lived in the Rented property for around Five Months until Christmas Last Year, then we Returned to the UK to see our Family.We returned to Spain in January and we made an Appointment to Submit our S1's. Unfortunately My Wife soon became Very ill, and She spent Weeks In Hospital,but She was Eventually Discharged. It was Decided that She could be better looked after by our Family, if we Returned to the UK. Our Problem is that we are now ready to Return to Spain in a few Months, but we are unsure weather our Residency is still Valid, and could we still get free Healthcare if we Return after the end of this Year ? The British Embassy Madrid states on its Facebook page britsinspain 5/8/20 if you have been legally resident in Spain for fewer than 5 years your status may be affected if you are absent for 6 months or more at one time, there are some exceptions to this rule where absence of 12 consecutive months may be permitted for reasons such as serious illness. As for registering your S1 was that not required at the time of your residency?

It’s unclear from your post if your wife, when she became ill in Spain, was treated via S1, EHIC or private heath insurance?
Despite the optimism of many Brits in Spain, there remains, for some, a degree of uncertainty regarding S1. I understand that if you are resident and already hold an S1, before the end of this year, this position will be honoured going forward. GOV.UK state it it will continue, however, there is no mention of it in the withdrawal agreement - only the draft agreement. This is as explained to me by a reliable source. Others may offer an alternative iew
I would suggest, that as visits to, and exits from, Spain, are currently unmonitored, it’s unlikely that your extended absence will have been recorded. After 31st December 2020, this all changes of course. Hope this helps 🤪🥂

There is no obligation to either obtain or register an S1.

The poster states that residency was gained last year and was going to return in January of this year to submit their S1s? So what the poster has not expressed is the type of health insurance used at the time of the residency? Perhaps they had phi, but think not as they returned to uk for treatment and looking back through the posters old post I would think not, but then again each to their own. What obligations would be required in this instance, I wonder, perhaps the original poster will explain the obligations he took, wonders will never cease.

How is that relevant to the question?
If they have residence, and 'get away' with the over extended absence, then they can register their S1's at any time either before or after Dec 31st.
Section 4 on an S1 is entitled "INSURANCE COVERAGE FROM/TO" where a starting date is stated - and confirmed by official stamp - but invariably the ending date is blank. Check yours out if you have a copy.
It's possession of the document which counts not when it was acquired.

Hi Peter, What Relevance has our type of Healthcare got to do with my Question ? While we were in Spain there were Several Problems with our Residency and S1 Applications. When we Returned to the UK, We were able to Rectify our S1 problems, so we returned to Spain to Present our S1's to the Authorities, Unfortunately My Wife became ill before we could do that, Therefore we need to Present our S1's when we Return to Spain Chris
