I have recently ended a rental contact in Albir for a family member, the agent sent me a legal document to sign, I didn't agree to the contents and told the agent this, and said I would not sign an agreement I didn't agree to, she became angry and started sending emails treating legal action, and throwing insults to me, in the 18 months I rented the property I never missed a payment, apart from the last payment which I was advised to skip due to getting the deposit back was difficult in spain, I did this and wrote a statement to the agent showing this missed payment against the deposit.  She has now said she will take me to court for (for acting in bad faith trying to deceive) has anyone heard of this before or had experience of this agent (Eurocasa, Altea).  Thanks in advance

Hi Simon,

Coincidentally, I've been reading about this recently and, legally, you can't withhold rent on the basis you've described.

Generally, people and businesses don't pursue court action, because the process in Spain is protracted, slow and costly.  However, if the amount you owe is less than €2,000, a landlord in Spain can pursue a "short proceeding", for which they don't need a lawyer and the process takes only a few weeks, so they may well decide that it's worth their while pursuing action against you.

Kind regards,

Kim

Even if the contract ended in July 2019 with no further contract signed by any party, I understand the laws in the UK, as I work in this industry, but in spain it seems totally lawless
