Non lucrative visa

Hello, we are Nicky & Gary

We are almost completed on our house sale in the UK and are looking into the application process for our NLV Visa ready for our retirement to Spain. It's scary stuff especially seeing the application is required in Spanish. 

Can anyone please tell me if we should employ a solicitor to help us or is there any more support out there as an alternative?

There will be plenty of suggestions and advice. 

Don't be tempted by sporadic offers of help from Internet posters.

A couple of sites that may be of help to you:

Citizens Advice Bureau Spain for bureaucratic stuff, and

N332 website for anything to do with driving in Spain.   They also have a Facebook page that has been keeping us up to date with the rules and regulations about the virus since March 2020.   Both sites are run in conjunction with officers of the Guardia Civil for English speaking people and the website has an English version of the Spanish equivalent of the Highway Code.

HI Nicky,

You need to make sure you are clear on the rules regarding Capital Gains Tax (CGT) as if you sell your house and move to Spain within the same financial year, you are liable for it in Spain, or so I think. Make sure you check it out, I've seen it mentioned on this forum before and its definitely something you need to be sure of!

The rules are if you spend 183+ days in a calender year Jan-Dec you are considered a fiscal resident(even if you don't have residency). So timing is crucial, if you sell early in the year, don't go to Spain or even apply for residency until July at earliest. That way you will not become a fiscal resident until following year and no CGT on your UK sale. It may mean renting or staying with relatives but again you need to be out of Shengen zone too so the 90 day rule can't cause overstaying while you wait for your residency. Good luck
