Need help finding a good solicitor- Issue with Neighbour and Management Company

 Hello

I am completely at my wits end with an ongoing issue with my neighbour  and management company and now need to get legal advice. If anyone has been through a similar issue can they advise me or recommend a solicitor that dealt with a similar issue  for them 

Background

I  live in Ireland and  have owned an apartment in Torrevieja for 17 years. In the past 5 years my apartment has been damaged 3 times due to water from the upstairs apartment. The outdoor area of the apartment upstairs has a larger outdoor area, and the tiles in my humble opinion are not sealed correctly.  

In 2020 the damage was particularly bad, and one room was inhabitable due to water dripping downs the walls . The management company through their insurance provider fixed the damage and I was assured  that issue in the upstairs apartment were resolved.  

I arrived in March of this year and again lots of water damage  I had a friend who is  engineer look at my neighbours outdoor  area and he said that there is an issue with drainage and tiles. He said that the damage is due to the lack of proper Drainage /Tanking and the interference to the design in the roof drainage system. Having reviewed the above apartment’s outdoor area it is clear that  

  1. Tiles are damaged and are not sealed correctly  
  2. The drainage system appears to be blocked as there is a residue of sand visible (which means that excess water cannot clear)  

I contacted the management company who had their insurance provider assessed the damage in my apartment. I explained that I do not want my apartment repaired until the issue is 100% resolved upstairs. I emailed the management company on the  5th of April and they said they are in touch with my neighbour upstairs but could do nothing because of the weather. I have emailed them numerous times  looking for an update I have heard nothing. I have also emailed my Spanish solicitor again I have heard nothing.  I was then recommended another solicitor who I paid 250 euro to and he said he would write to management company and my neighbour .

What a nightmare,I really feel for you.

If you contact your insurance company, they will send their accessor out to inspect the damage. If and from what you say,the damage is being caused by your neighbours terrace allowing water to pour onto your place, the accessor will make contact with the owner and act for you.  This is your best way of dealing with the problem. It seems wrong that you are out of pocket because of your neighbours neglect. Let me know however you get on. Good luck.

Have you contacted your own insurance company? They should be chasing this on your behalf.

Thanks so much I'll get in touch with them they haven't been very helpful in the past but I will contact them again

When you say management company, do you mean The President and Commitee of your community?

If you do not live on a Community, is it a private management company that you pay fees to for maintenance etc ?

HI Yes it community not a private management company I have written to the president and the Admiburgos

The President would be responsible for arranging Community insurance so he/she should help you or give you the comapnies number.

I am a President, sadly some do not do a very good job.

The Administrator works to the President but they should be able to help you.

I recommend you call them.

Thanks for your response yes i sent a letter to president last week  with photos 

of the damage and have been in touch with the Admiburgos who have not responded
