I need to stay in Spain longer than 3 months I have a home here , as I cant fly I have to catch the ferry home if I stay say 2 weeks more than my 90 days allowed what could happen , could I possibly get a Visa, or something from my solicitor??? I sure go home on the 28th ferry but I need to travel to Santander first and before that its bank holidays so I was thinking January 12 or something like that

You risk a massive fine and a ban from entering the country if you overstay, there is no visa extension available just because you own a property here.

If you overstay you could be fined up to €10,000 and at worst be banned entry to EU countries for 5 years.

Presumably you have  correctly calculated your 90/180 days then unless you have extenuating circumstances you will not be able to stay and run the risk of being banned from Schengen for up to 5 years and a huge fine. 

The three red days in December on the 6th 8th and 25th should make no difference to your travel plans.

 If returning straight after Christmas Day is a problem for you why don’t you return to the U.K. now for two weeks now to keep you in your 90 day limit?

Hi Suzanne,

Whilst there is a process for applying to extend a Schengen short-stay visa, they are rarely granted.  Only you can decide whether it's worth the effort of compiling the required documentation, attending interview at a foreigners office and, depending on the reason you give for requesting the extension, paying the required fee, in order to stay just an extra couple of weeks:

If your application is rejected, you will not receive a refund of any fee and you'll have to leave within 24-48 hours, so if you've booked a ferry in January in the hope of a successful application, you're unlikely to have sufficient time to leave the country by ferry, and then you'll end up being an overstayer anyway.  Personally, I don't think it's worth the hassle, but as I said, only you can decide whether it's worth a try.

Reading your post as a disinterested 3rd party what you're really saying is that you WANT to overstay not that you NEED to.

Extensions are only granted for truly exception reasons and I'm afraid yours fall well short of that.

I hope Suzanne overstays her 90 days and then she can come back on the forum and let us all know the consequences. We could use that post for a warning to others who want to test the system.....

Be prepared to be fined and or banned from re-entering,your choice.Best bet is to leave Schengen Area to stay legal then return as and when you free up days from the rolling 180.Would you like to be banned from visiting your home in Spain from overstaying just 2 weeks?Probably not.

Its the law.you have 8 weeks plus before you say you are going back your solicitor cannot help you. Go back in december or risk breaking EUROPEAN LAW some one is going to cop it dont let it be you.
