Hi Folks  My wife and I , aged 89 and 93 , have jointly owned a villa in Moraira for over 40 years and are planning to transfer the ownership to our daughter.  There will not be an actual sale via an estate agency but as we have had the property independently valued at over 500k   will she be able to apply for a Golden Visa  based on this valuation  ??    

Also , although she will be the new sole owner of the property will her  partner of several years standing  be able to also apply for a Golden Visa  based on our daughters ownership and their joint  longstanding co- habitation ??

Golden Visas are being stopped in Spain for property sales. Announced on April 9th and  still  to be agreed in Parliament but they are going and the government said they will look into not allowing any new applications to be made.

I think those ones currently applied for are being given the go ahead.

I can't imagine that it would work as you described. You have to show that you are investing the money into property whereas your property is already there and paid for, therefore not a new investment as such.

Marcliff has explained the new rules about Golden Visas.

Notwithstanding the aforementioned imminent abolishment of the golden visa, I doubt your ploy would work anyway because it's a hard cash investment of €500k which is (was) required.

Given the above your question about her co-habitant is moot.

Alan,

    what you are describing is not the usual scenario of those applying for a Spanish visa so I recommended that you seek advice from a lawyer specialising in Spanish visas. Given what has already been posted here you might want  do that as a priority.

All that aside, transference of property to another family member is not as straight forward as in the UK. One simply cannot just inherit property out here without there being a tax implication, which currently stands between 7.6% - 34%, so based on the valve of your property, whomever stands to inherit, or takes over ownership, will have to stump up between €38,000 - €170,000.

Might be worth selling.  As your both over 65 there won't be any Capital Gains Tax to pay.

There will be taxes but inheritance and gift tax in the Valencia region has all but been abolished from parents to children. There is a 99% exemption on such transactions. Yes, it can be up to 34% in some parts of Spain but not in the Valencia Region.

There may be plus valia and transfer taxes but not inheritance or gift taxes anymore. 

However, bit of a moot point as the OP was asking about the Golden Visa which is being abolished for property purchase.

Get hold of a solicitor who knows how to get around in Spanish beuracracy, and ask for advice. Just transferring may not give you the wanted result, and may end up costing unnecessary money. Be clear about the purpose.

Sadly the Spanish government have announced they are ending the Golden visa scheme. In any case it requires an actual purchase in excess of €500,000 to qualify. If your daughter and partner can work remotely in Spain they might qualify for a Nomad
