Hi Guys

I sold a house 15 months ago & purchased a new home 1 week later, I believe the government take the 3% retention straight after you have sold your home & when can you claim this 3% back, what is this taxation called.

I have not received my 3% to date  from my solicitor, can you advise.

many thanks

Hi, from similar posts I have read, you only have a short limited time of 30days to claim for the refund and your solicitor should have claimed this for you. Get on to him and ask why. When we sold 1st spanish house 2yrs ago time was not so short to claim, after constant emails to estate agent(we didnt use a soicitor) , we discovered on phoning, he had scarpered from Spain stealing peoples retentions and house deposits and it was in the Costa Blanca News and on the internet. Never got it back, but so sorry for many people losing big money house purchase deposits. This was a British agent in Gran Alacant.

Hi,

attached explanation of the 3% that is withheld from non-resident property sales:

https://www.idealista.com/en/news/financial-advice-in-spain/2021/06/17/17004-non-residents-3-tax-rebate-on-selling-property-in-spain

Maybe start by asking your solicitor what is happening with any rebate.  At the bottom of the article it states that you have up to 4 years to claim money back.

Rgds,

Aitch.
