Form 85 HMRC

Anyone filled one of these forms to extract themselves from paying tax in the UK after becoming tax resident here in Spain. Trying to achieve a ‘nt’ code to avoid double tax when I start to take drawdown from retirement fund.

In 2017 the HMRC form I used was called 

DT - Individual. (You may have the same form by a different name or number)

I obtained a Tax Certificate from Tributaria, attached it to the DT Individual and sent it off to HMRC. Job done (although I still get occasional reminders about the dates for filing self assessment in the UK)

Not sure though what the NT code is that you refer to.

NT = Non Taxable.

The form Spain Individual is for those settling in Spain (used to be called the FD9) . The form 85 is for use outside the EU countries.

How did you obtain the required Tax Certificate from AEAT please?  I asked our tax advisors if they could obtain mine and they didn't seem to know what I was talking about (but perhaps they thought I was going to ditch them and do my own tax returns, LOL!).

Hi Kimmy 🙂 hope you're well...

I completed the DT - Individual and took a copy to my local tax office in Denia. 

They wouldn't speak English to me but I managed to be understood and the clerk said the Certificate would be ready to collect the following day. Incredibly, it was!

If only everything was as easy!

Ps, it took HMRC a while to "get the message" because in year 1 they tried to fine me for late filing of SA. I had to write to them with a further copy of the DT - Individual and the AEAT Certificate and they quickly cancelled the fine.

You can request the tax residency certificate online at this link https://sede.agenciatributaria.gob.es/Sede/en_gb/no-residentes/certificados-residencia-fiscal.html

You need to select application and then fill in your details. They will then send you a letter with a long code. Back to this same page and then request submit documents with the long code they send you by post (took about 5 days for mine to arrive).

You can then print off the certificate showing you are a tax resident in Spain. Note that this code only works on one PC or tablet or phone.

If you download the certificate to a PC you can only use that particular PC to view it or ask further questions. 

The certificate tells HMRC that you are a tax resident and tells them how to access the details of dates etc.

Actually only a six page form. Thank goodness.

It can be used by individuals resident in Spain to apply for exemption from UK income tax under the Double Taxation convention. Can also be used to claim back any tax already collected in the Uk.
