I think Catral was a special case as corrupt officials in the past have overcharged for the Habitacion Certificate and therefore everything has stalled but unless in a protected park area, they are just some of about 120,000 illegal properties in the province of Alicante that have been bought and sold and lived in quite happily for many years and there are estimated to be 400,000 in Valencia as a whole.
With the confusing and ever-changing political set-up it seems as if there are never enough politicians across the spectrum who agree at any one time how to sort this problem out and see it through to a final outcome.
It all started when dodgy developers started with a plot of 10,000 m2 which was the minimum area to build a property in a rural area up to 2% of the land and started to build up to 5 properties, making them illegal.
It is my experience just down the road in Albatera that there is no problem transferring the names on utilities on selling/buying but if the services are disconnected for any reason, you cannot be reconnected without the certificate. We paid for the new EU approved tank to be installed and now have our Habitacion Cert and certificate of no infraction but Catral will be different, especially if in the park. We do know that we are severely restricted regarding any further building works or hard landscaping.
If your abogado is independent from the estate agent and documents show no demolition order, you take your risk along with the 400,000 of us others!
I think we would have put the new tank in anyway as we are not nearly so restricted as to what we can put down our drains and toilets and we don't have to keep delightful little bins for used toilet paper.
