My sincerest sympathy for your loss, I hope time will be a good healer and remember no more pain and hospital visits for Margaret now she is at peace.

I had read that yesterday after all the scaremongering rife on facebook even though it doesnt affect me. We have now decided after so much research it would not pay us to be residents at this time and I thank you for your part in affording me so much valuable information. My only worry now is after arriving day before lockdown in March, I want to stay on until October as originally was going home early June, cancelled three times and returning beginning of September, but if I stay full distance it will mean overstaying 183 days and dont want to get caught up with fiscal residency plus a vehicle here in Spain for over 7months. Seems I need to rebook ferry for fourth time for early September(182 days). I do so love October though.

During the lockdown, the limits on length of stay were suspended, so the 90 day and 183 day rules didn't apply. In theory, those limits do now apply. However, the length of stay of UK citizens won't be officially monitored until the transition period has ended. In addition, the way that Hacienda check your presence is by consulting the padrón database, not by checking passport entries, so it's very doubtful that the length of your stay will be picked up.

Thanks for reply, 10yrs ago we were told to put ourselves on the padron and we did, but then a year later, someone turned up to our house with a renewal form to sign but hubby wasnt with me in that visit and after I,d researched we never took them back so we havent been on since. I hope to believe they have never used our names from that time to gain their extra funds. As our van is only used on journeys not during the stay, are we facing any chance it could be confiscated on journey back if checked by police? This all seems so weird when thousands have done it and still doing it and I just dont want to appear disrespectful of the rules, especially with our diary of bad luck. As we dont use a gestor(other than Andy doing our INR), dont have an authorative person who can advise, should we receive a tax demand.

Oh well decisons, decisions!

You don't need to bother about the padrón. If you weren't removed from it after the visit, you'd automatically be removed five years after signing on.

I can't envisage any problem with the van, in view of the fact that you're non-resident. It's only residents, or those illegally signed on the padrón, who would incur problems with a foreign registered vehicle.

I wish I could give you a hug 🤗 , you have given us the confidence to experience for possibly the only time a long spell of spanish living which you so much love. I,ll keep watching in case as Cheryl in another recent post has predicted that Spain just may bring out a procedure to allow a differrent freedom of movement just for Uk citizens after Brexit.

I admire Cheryl's confidence, but I'd have thought that, if the UK was going to be treated as a special case, then this would have been reflected in the new legislation.

Ah, but Jim they have changed the original procedure for the new TIE changeover as you say, normally first time 1yr but now changed for UK to 5yrs, so??

I,ll not hold my breath, my decision is made and resigned to non resident visits.
