Help for guests stranded in La Zenia

Hi everyone, I am after some advice regarding the current situation surrounding the Corona virus. I am in the UK at the moment but some friends have been staying at my place in La Zenia, I am a none resident. I have been advised that they will have to leave within 7 days or I could face a 10.000 euro fine. The problem is their flight has been cancelled and they can't gat home. Has any one else had a similar experience as this must apply to a lot of people?

Who advised you that, "that they will have to leave within 7 days or I could face a 10.000 euro fine"?

It was my property manager who apparently was told by his solicitor

Their flight was was 30 March but cancelled and they were told they could not get another until the end of May. They were just going to wait it out but are now concerned about the 7 day edict and possible fine (so am I!). They are looking for alternatives but not much luck, they are with Ryanair. I have emailed my own solicitor but no reply yet.

Hi Blanco,

It sounds like your property agent and their lawyer may be quoting the consequences for overstayers in normal circumstances.  In any event, if your renters are citizens of the UK or any other EU member state, they can be in Spain for 90 days without sanction - and this time of lockdown is not normal circumstances.  Whilst you await a response from your own lawyer, I'd ask your agent for sight of the law that they're relying on.

If your property has a Tourist Licence then this may be linked in with all the hotels having to close by Thursday, which includes such lets. If it is not a Tourist let and your friends are staying for free then they can stay but it could be for a very long haul as I can't see this going away any time soon.
There are still repatriation flights leaving Alicante so it may be worthwhile your friends doing their utmost to get on one of these before they all stop.
Whilst it may seem like a good idea now to have an extended holiday, if one of them gets the virus it may change everything. Not that the UK is any better but they will have their usual support network around them in familiar surroundings.

Thanks that sounds like a very sensible view. My place does have a licence which my property manager arranged for the rentals he organises. That’s probably why he has interpreted it this way. But yes they are staying for free and are not his clients so should be ok. They are also keeping an eye out for flights. Thanks again.

I'm not sure with this scenario because it has a Tourist Licence it could well be that it will have to close unless occupied by the owner....?
