Selling my Spanish registered car back to a UK resident?

Hi all.

I bought a car in the UK (LAND CRUISER 80), back in 2010, and matriculated it and paid all taxes.  I spent a small fortune on it setting it up for camping and it has been great however, due to ill health have to sell her.  I may have found a potential buyer who is a UK citizen and he will be taking it back to the UK, apart from the usual contract being signed and paperwork stating it has a current ITV, it will be a 'cash' sale am I missing anything tax wise for example?

Hello, you are fine. As stated by yourself you have paid all the fees (Registration etc) and taxes to Spain (Import Duty) Make sure you take a photocopy of the driving licence and the persons passport, (Purchaser)  also an up to date picture including/showing the Spanish registration of the said vehicle. Take a picture copy of the vin/chassis number of the vehicle. Also keep copies of the paperwork you have for the vehicle. The reason I mention this, if there is "a come back over time" you are not fumbling around in the dark wishing you had reference in paperwork. Write your bill of sale out, dated and the time of the sale which will cover you if the person drives of at a silly pace triggering speeding machines or an accident. Both sign and each keep a copy. If you are selling to one of the very many companies that are now exporting Spanish vehicles to the UK ask them for their  VAT number and business card which should have all the details on. If a business they should give you paperwork to show the vehicle is being exported back to the UK. The onus is on the purchaser to pay import duty if any when the vehicle is back on UK soil. You do not mention the year of the Land Cruiser 80. Purchased new in 2010? or came into your possession in 2010? They have been around for a number of years. From Memory under 30 years old approx 17% to 20% import duty EU registered to the UK,  I forget the other way around however not really applicable. The Spanish do tend to impose a fee when selling a vehicle depending on age and value, not your word (what you sold it for) but the market book price. You may get away with it (Percentage in vehicle tax/sale) however to reiterate you know the year, details etc. I have had work done to my property a reform, building etc already there but needed tidying up. I had to pay our Town Hall/Ayuntamiento 4% of all costs to my property. So there you are this is Spain, everything has a price in % to pay. I hope the sale goes well. Sincerely. R.

The car is the model 80 from 199, it is considered the last true off road Land Cruiser built.  I was not 100% sure but always good to ask.

Hi Dave,

My concern is that, if you don't make the transfer of ownership official in Spain, this could leave you exposed in the future.  Unfortunately, the process isn't as easy as it is in the UK - you still need to deregister your ownership with the DGT (Trafico) and pay the relevant fee and any transfer tax, not only to protect your own position, but to ensure that the buyer doesn't have any issues when they come to import the vehicle into the UK.

Here's a link to a Contract of Sale template from the N332 website (created in conjunction with the Guardia Civil police) - although it's in Spanish, the second page explains in English how to complete it:

When we sold my husband's car, we used David at Orke Servicios in Los Montesinos - from memory, the cost for his services plus the transfer tax and DGT fee was €345.  Or you could cut out the gestor's fee and do this yourself with, ideally, both you and the buyer visiting Trafico together.  Whichever way you decide to go, agree with your buyer who will pay for the transfer - I've seen various articles suggesting it's the responsibiity of the purchaser, but you both have a vested interest, so I'd suggest splitting it, which is what we did.

Hi and thank you for your enquiry, I am looking for €14,000.

I am not just selling the car, during the 13 years I have owned it, I set it up to be able to take me on camping trips, weekends and be self sufficient for around a week. So it has everything.  Remove the seats (8 bolts), and a complete custom built modular camping kit goes in.

Everything including fridge, cooker, heated wardrobe, yeh I know.  On board water with pump for shower, full length roof rack with RTT, second spare, additional fuel, solar panels with controller, Hi Lift jack, sand ladders, there is an incredible amount of kit and way too much to list, it even has the ability at the press of a button to jump start itself!  I intend to sell everything in one go.  I am only selling her due to ill health, so unless you plan to use the 80 for camping this might not be something you would be interested in, of course you can view her, but I do have someone coming over to view tomorrow afternoon.
