Can anyone explain the 90 or 180 day ruling please. Q, we have our apartment and go there for 4-9 nights at a time, how does the rule work ? Is it over the course of 12 months we can only go upto 180 days doing the short stays we have been doing or is it 90. Thanks for help in advance.

Hi,

The 90 in 180 rule does not have a fixed period of the year but is a rolling period.

You are allowed to visit EU countries for a period of 90 days maximum in a rolling 180 days. As days pass one day drops off and a new day added to the period.

I have given you a link to a site that explains the rule and a simple calculator to put in start dates and end dates, it will then work out how many days you have left to use in the rolling period.

All will become clear once you have studied the rules and the calculator.

Note: 1st day starts as soon as you enter the EU.

With pedants hat on its not when you enter the EU but the Schengen area.

It's perfectly possible to say fly from UK to one of the non Schengen countries such as Bulgaria, Cyprus, or Romania, stay there effectively for as long as you liked, then travel to Spain which is in Schengen and when your 90 days would begin.

Cyprus joined the Schengen Information System on July 25th, 2023. It is expected that Romania and Bulgaria will join Schengen free-travel area by the end of 2023.

Why would the OP want to fly to and stay in those countries when his property is in Spain?.....

The OP wanted to know about the rules so he can visit his property in a legal way!
