Hi Alan mac,

The border guard was correct, when you're travelling with your EU citizen spouse, the time in Schengen does not count towards your 90 days allowance, but when you're travelling on your own it does - that's why it's especially important for Third Country Nationals married to EU Nationals to keep separate notes of when they travelled alone and when they travelled with their spouse - and be able to prove it.  How else are you to demonstrate why a passport stamp appears to be missing ftom your passport?  I sincerely hope that the roll-out of ETIAS next year will provide digital tracking for travellers and border control alike.

Hi Alistair, from the last part of your post are you saying to try and get an exit stamp when you arrive from local police station or before leaving (going to the airport or border control if driving), I very much doubt the police would accommodate that , either backdating or forward dating, I may have mis-understood what your saying exactly.

After reading my post I forgot to mention I Arrived at Alicante Airport!! The policia local office is IN the Airport!!! And they deal with immigration!! I would not advise going to any outside police office as another person as mentioned in a post. Only a Airport one on Arrival!!  I would also assume the same for any other Airport or if travelling by car etc, there will always be police there on arrival to assist!! You just might need to find them as I did!! I went to guardia civil office first, and they told me policia local deal with that and pointed me to the office, Whatever the case, deal with it on point of entry/ arrival.

My parents are in the same position... left Alicante after a five day trip in October without a 'return' passport stamp, having gone through a passport scanner. No boarding cards as proof as they shredded their printed copy, just booking confirmation emails.

I'm thinking it might just be easier for them to buy new passports (which will obvs have no stamps at all in) before they return to Spain in March, as they'll be arriving into a ferry port then. And they're a bit too old (and now worried about this situation) to be reckoning on finding a nice, English speaking police officer to put it all right.

I returned to UK yesterday and at passport control there were plenty police there after scanning passports to stamp passports, so it seems they are addressing recent failures in lack of exit Stamping!!! 

Unfortunately this does not help your parents, and I fully understand there predicament if returning in March, and the thought of stressing about it till then.

You could contact the Airline and request there flight confirmation which easy jet told me shows boarding status and is accepted by immigration control, mines never arrived in time for leaving to Spain but my phone boarding pass was sufficient.

To be honest I truly feel your average policia local officer on arrival back to Spain would be understanding but it’s the worry until then that made me address it whilst still being in that 90 day period. 

My passport was new, so it was not a option for me, but if your parents passports are nearing expiry anyway it might be a good idea to renew them, it’s probably as cheap an option as flying back within the 90 day period to address it.
