If you read Kelvin's post he already is a resident and was a resident on selling his UK house. On applying for residency it is a condition you become a tax resident anyway as you can't be out of Spain more than 6mnths to retain residency, however I have never heard of the "9 month final period" you mention to avoid CGT as surely once you have residency, you are in effect a tax resident from then. Exception to that rule if you get residency in the last half of year when there are less than 183 days left in that year.
