Can a president on a community decide rules for building works etc on our property

We want to put up a carport we put it to our president 

He requested that it had to slope from front to back which does not make sense as even with guttering if there is a heavy deluge of rain the back of carport would be like waterfalls like Nigeria falls, whereas our choice would be to slope just slightly left to right with guttering and if a big downpour the residue would go into the trees, making much more sense

The other request was not to put the posts and start the roof from the front of our property ( like many on villermartin) but to start from front of the house, this also is a problem because the way the sun is on the front most of the day, and the carport cannot go any further back as it would then go over the bathroom wi for making if needed escape out of the window or even being able to open the window

The carport does not need building permission from local council

Does the management company and the president who is just a owner on our community like ourselves have the right to tell us what we can or cannot do on our property

The President can only enforce decisions made and voted by the General Assembly. The admiistration hs no power and reports to the President. Any communicatios are not valid unless signed by the President whose rights and obligations are ñaid down in the by-laws which should have given to you together with the purchase deed..Whatewver you do on or with your private space is your own business. Anything that can be dismounted does not need permissions. Some items must be tolerated by the community, i.e. antennas, aircon equipment, clothes drying racks.

I would have thought you need a license for the works from the Town Hall and that would set the precedent for the construction

You can go to the administrator's office to find out what you can do. The rules of the community are decided on by the community and the administrator will have them if you don't have a copy. There are state rules, autonomous community rules, town rules and community rules. The administrator will know.

I think it also makes a difference if the property is adjoining another one with a shared wall. If the carport doesn't need any foundation work then you probably don't need a license but you probably need permission from the community.
