We were in a shop in Oliva a few weeks ago where there was discussion going on about a couple visited by police on day 91 asking why they had not left…

It's quite possible that it will be recorded by the stamped passport. You could be fined and even denied entry to the EU for a period. Is it worth the risk?

If you spend more than 90 days in Spain within a 180-day period—violating this rule— you will face penalties. You may be required to pay a fine, leave the country, and be banned from entering the Schengen Area for a specified period.

I over stayed 11 days last January nothing said going to stay longer this time why shouldn’t I I have a home here in Spain pay all my bills and community tax

I suspect it is a bit like russian roulette, you'll get away with for some trips but eventually they will spot that you have overstayed. Then they will probably look back through your passport and pick up on the other times you have overstayed.. Then they will fine you, if you are a regular overstayer they may even give you a ban on re-entry for a period of time, certainly they will give you an increased fine.
While you are fined and possibly banned for some time you'll still have to pay your Spanish bills! It's not worth the risk.

The story you overheard sounds a bit far fetched to me, apart from anything else how would the police know the whereabouts of couple to be able to get there within 24 hours of them overstaying? Possibly they visited them for some other reason and did a routine check on their passports.

There was a topic on here recently and a couple posted that they were stopped for a minor motoring offence ---when their details were checked they were told firmly that they had overstayed (by a few days), issued with a fine & told to leave Spain immediately! Unsure whether fine was for motoring offence or overstaying but they left within 1/2 days!

You are not resident, you are a holidaymaker, therefore you are not entitled to stay longer! That information is all that matters..... house owning is irrelevant.

I have seen a stamp in a passport of a friend who overstayed in uk. Banned for three years to enter the UK. So it is not only Spain. With strict passport checks, recently introduced within Shengen zone, to curb illegal immigration, I wouldn't risk it.
