I have been working in a restaurant in Algorfa I have since left there because of illegal payments to all staff working there

I am looking for some advise on this issue has payment for my time has been with held

When you say illegal payments to all workers do you mean payments made without contracts being given?

If you have worked there on the promise of a contract and left because they lied and are now withholding funds from you, i would report them or threaten to. A rota or something of that nature with your name on could come in handy.

It's shocking how much of this still goes on and is a slap in the face to those who wish to do things legally businesses and staff alike.

The Spanish contribution system doesn't make it economically viable for an employer to put restaurant/bar staff on contracts.When a barrel of beer costs 50€ for 30 litres and a customer is charged 2.50€ for a pint.No wonder so many businesses HAVE to do it.Unfortunately,they then get caught,sometimes,not all the time.The staff also suffer as a result of not getting health care, pension etc. Catch22

Report them to local police as its local issue ,why on earth do b rits come to Spain and work for 5 e and hour when they would not do this in Uk.

Once  upon a time UK expats retired to Spain now there seem more coming to work most on lower wages and illegally . In this heat

Pretty straightforward advice as in every western modern country. If you want to work illegally you cant readily complain and win a case because you are working illegally too.Yiu can still shop them but be careful on ramifications. If the work is legit and legally sound then get a contract sorted as soon as you can with the company. Get it in writing. The contract should include  

  • Working hours
  • Location of work
  • Start and end dates of the contract
  • Number of holiday days
  • Period of notice for both the employer and the employee
  • Salary, supplements and benefits.

If  they breach any of that then you can exercise your rights over and above basic employment law. If the contract is crap dont work for them
