Legitimate window replacement work done in April, everything paid but STILL not received final bill/guarantee? Any suggestions??

We used a reputable local company to replace our windows in April... Everything went fine - apart from dirty workers... but work was done and I paid the bills..all legit.. .As I was leaving then I expected to receive the final bill/guarantee as proof of payment and guarantee for the expensive windows which had sticker on them of a 10 year guarantee.. Despite numerous emails since April STILL no final bill neither by email or by post. I dropped into said company 2 weeks ago.. and the person there said that their computer was broken...two weeks later and STILL nothing.. Any one any suggestions as what I can do? I did take a photograph of the sticker on the windows but to me honest I don't consider that a serious enough 'guarantee'.. thanks for any advice...has totally put me off using local companies...

I's ask them for their 'hojas de reclamaciones' - complaints book. I'm sure they'd rather provide a final receipt than have you registering a complaint that would go to the town hall OMIC office.

Thanks Jim, I'm really fed up with them.. I mean countless emails and I even visited there 2 weeks ago.. thanks I'll do that once I sort out the chaos that is trying to put through an order with Ikea... for some unknown reason it doesn't like my address... so when I call them they say 'ignore it'... but you can't... so going round in circles!!! Someone told me to tell them I'm calling the police, but to be honest, i find that a bit far-fetched... I had thought about contacting the Ayuntamiento so thanks for letting me know what I need to ask them to show me: guess that's a visit due tomorrow!! thanks a lot !

Hi,

I know that calling the police in the UK for this kind of dispute would be considered time-wasting, but it isn't far-fetched to call the police in Spain - the Policia Local deal with these types of matters as routine.  It's most effective if you're at the window company at the time!  You should also call the police if the supplier refuses to give you their complaints book.

Friends of mine ordered and paid for tiles from a local shop - numerous calls, visits in person and more than 6 months later, they made a final visit to the shop, refusing to leave until they were given a refund.  Curiously, the shop owner called the police to report my friends - perhaps in the hope of frightening them off - but when the Policia Local arrived, they listened to both sides of the story and then ordered the shop owner to refund the money.

If your window supplier is reluctant to issue a final bill, perhaps it's because they're failing to declare IVA (VAT), in which case they definitely won't want to attract the attention of the police.

Thanks Kim... I'll keep this in mind... at the moment swamped with gardening/plumbing issues today.. But intend to drop by the shop next week before I leave... I paid everything with VAT and they were very expensive windows so I want that 10 year guarantee written down on the final bill.. I don't think my photo of the sticker on the windows (which I had the foresight to take) would suffice in any court as a 'guarantee'..which is what the ditsy girl in the office said..the same one who said their computer wasn't working.. Over this weekend I'll type up a chronology of all the emails , visits etc I've made since April and have that ready with me when I go there..

As for the VAT here... what it is ?? I've never seen so many 'legitimate' companies not declare things!!  thanks everything you've said duly noted for next week!

Hi,

IVA is 21%.  I always use legal companies, but it's amazing how many companies don't even mention IVA in their quotes.  (By the way, if a company is caught not providing a proper, IVA receipt, the fines are punitive.  Also, if any company wants you to pay more than €2,000 in cash, don't do it - if caught, both the company and the consumer can be prosecuted.)

It's really important for you to get a proper receipt, not just for the guarantee, but if there should be accidental damage to the windows at any time, your insurers may reject a claim without a proper receipt.

Thanks Kim for your advice.. I'm going to do up a chronology of all the emails I've sent since April and visits to their office so that I'm prepared when I drop by next week to get that final bill.  I think not having a good basis of Spanish doesn't help either... Must admit got two quotes for gardening work and the legitimate company was only 100 euros more expensive than the neighbours gardener...which gave a quote on a typed up sheet ie. like using an old typewriter...with different name to stamp of company etc...all a bit dodgy and of course no details..so we went with the legit company and must admit very happy with them and their professional service... proper quotes explained very well and then bill when paid...all above board..  That's why we went for the legit company for the windows too.... !  We've had problems with the fact that the door mosquito can't be kept open with the metal shutters down... and have been trying to contact company about that since August...so will definitely write up a note with email traces as proof before confronting the owner... It's definitely a learning curve!!

Thanks to all for your advice, after 3 trips to the shop (including ringing doorbell of their house), I finally got the invoice... needless to say it wasn't the owner who was at fault, but the person working in the office...proof if ever I needed it, that the owner should perhaps recruit someone else!!! Thank you for all this information, I've kept all the consumer rights information just in case this type of thing happens again with another company!!
