Advice on chimney installation - Our Neighbours new chimney appears to be too low and causing problems.

Hi, our Spanish neighbour on the urbanisation has installed a log burner. We have no problem with this, but he has erected the chimney flue on the solarium part of the house, not on the roof above. This does not look very sturdy and it is below the actual rooftop. The fumes and smoke are coming across and we can smell it in our bedroom. The washing also smells of smoke. We are a row of town houses and he is next door but one. In the UK, chimneys have to be 1metre above the roof, is it the same here? I want to be sure of facts before we approach the urbanisation president. Thanks
