Hi, we previously found a property and paid our reservation of €1,000 but two weeks later the seller pulled out with no apparent reason? I received my full reservation back but someone has told me that because the seller cancelled, he should pay a further €2,000 to me for cancelling? I was told this was Spanish law?  Does this still apply please?  Thanks in advance!  Karen x

Thanks! Would this detail be in the reservation contract?  We do have an abogado now because we have found a new property and should complete any day!  We didn't have him for the first property, as the cancellation happened before we got him!  I will check the contract now.  Many thanks!

You could get double the amount in case you made a "contrato de arras" or it was clearly specified in your contract.

If this was just a reservation to take it off the market to the agent(which is entirely unnecessary) then you were probably lucky to get it back in the first place. The double the deposit thing is true but only for the deposit I believe, but I may be wrong.

Thank you! I have read the reservation contract and it does state that if the seller or the buyer breaches the contract then they will have to pay 100% of what has been paid so I should have got double my money back, not just the amount I paid in!  The estate agent are due a phone call in the morning, I think!

Thanks very much!
