Responsibility?...

Imagine the scene...
A 'friend' of mine, 'rents' a bar in Torrevieja.
During the recent storms the bar is seriously damaged.
Then the 'owner' of the bar says to the 'tenant', 'It is YOUR responsibility to replace the damaged area, which has cost more than 11.000 euros.
5000 euros +, was paid by the insurance company, leaving balance of some 5000+ euros to be paid by the tenant.
The 'tenant' is NOT the owner, just the tenant.
Why should the tenant have to 'pay up'?
The tenant did NOT build the damaged area in the beginning, and the structure was held together rather badly (This is why the damage occured), INCLUDING being held together with 'POP RIVETS'!
Should anyone may have experienced anything similar to this, then I would be grateful for the way forward and to learn of a possible solution.
Thank you...
