We are only taking into consideration Spanish assets. We started about 8 weeks or more ago, and our mails were ignored initially anyway, taking it further. Because my wife is Italian the situation is not like the UK or Spain for that matter. The wishes of my wife were in question and we went back...

... back to Italy for other reasons but at the same time got clarification of the laws regarding succession etc. Actually they are very simple, They did not appear to have any idea of Italian law regarding a testament, only about being intestate. The Notary's office received this info and we were given an appointment for a couple of weeks later, In point of fact yesterday. We got a call as we were about to go out to the appointment, and just 2 hours before the appointment saying that the notary was not sure and that they were cancelling the meeting until a later date. Obviously the left hand did not know what the right hand was doing and the notary was only their for the signing.Tomorrow we are meeting up with an Italian friend who has gone through the procedure and he has also confirmed what we had been told. On Monday I will inform the notary's office that we are not happy with their performance and that we wish to cancel our cooperation in this matter.

I will probably contact getlegalinSpain for the little extra costs, as recommended previously.

I was looking back at my emails and I started with this Notary on the 24th of May this year so it is nearly 3 months.

Whilst in Almoradi I found out that you can have a will drawn up by a Notary ,fully legal, cost myself and wife €50 each, done and dusted .

My contact then was a very helpful John Ward who worked in the estate agents,I think it was Inmorales ,just off the square opposite the town hall on the corner .

We wanted to make out standard wills each and was bemoaning the cost through a lawyer and John explained the local Spanish make out theirs this way.

We went with him and they were drawn up and lodged in the Notary and a copy in central records Madrid

Worth investigating ,price may have gone up but nothing approaching what the lawyers charge foreigners.

Worth an enquiry,nothing ventured etc.

Hi Steveyjoanna,

Yes, the company that Mrmike is using typically charges around €30 per person for a Will.  When you use a lawyer as an intermediary, you're paying for lawyers' much higher hourly rates.  For the average Will this is probably unnecessary, but more complex estates may require legal advice.

Kind regards,

Kim

I called the notary's office in Almoradi and cancelled everything, All confirmed by emails too!  I contacted Uma at get legal in Spain, she is on holiday until September. I spoke with an Italian friend, he had his will done by a notary in Torrevieja, 37Euros and 50Euros for a dual power of Attorney for his Heirs. So I will get in touch with them at the end of the month when most of the madding crowd have left.

Thanks everyone for your suggestions etc.

I have seen mentioned in several places about recovery of the will/s what exactly is this after all we would have copies etc?

Exactly right, you have copies, When you sign the Will before a Spanish notary, they retain the original, as when you sign the Will in Spain, then the notary informs the The Registry of Last Wills in Madrid the date and place at which it was signed, the Spanish Notary retains the original. Get Legal in Spain offer a service of recovery/Help in obtaining the legal documentation in helping the claimant/beneficiary who may not have any understanding of any of the legal and other procedures needed in Spain on a death of a loved one in what may be a traumatic time. I would rather have someone inside the tent peeing out, than outside peeing in.

Hi, We have been using www.pardinesygonzalez.com  in Torrevieja for 20 years.  They did our Spanish will, also an english copy. All we did was turn up at a notary and sign them with no problems.  We deal with a lady called Almundena who always answers our emails and speaks perfect English. We have them on a yearly retainer as we live in the UK and they sort out any problems we have. Hope this helps.
