Hi mellor7,

The laws of the Supreme Court of the UK preside over the individual laws of England & Wales, Scotland and/or Northern Ireland.  I can find no legal reference to "British" laws.  UK citizens, whether resident or non-resident in Spain, should satisfy themselves that they understand how they are bequeathing their estate - choosing the cheapest option will not necessarily achieve this.  Ultimately, people have to satisfy themselves that they have thoroughly investigated all options and pursued what is best for them.

Hi Kim,

Thank you for taking the time to reply. The notary I used was recommended by quite a few people, so I am surprised that they seem to have made this "mistake", and wonder how many other people must have the same wording in their wills. It is such an important document, so it needs to be correctly written, whatever the cost.

As the original instigator (I think!) of this topic, I seem to have stirred up a right can of worms, unintentially I would add.   I was hoping to clear some muddy waters, but now find myself more confused than when I started.  Reading some of the replies on here, it appears that some Abogados have differing opinions as do some subscribers   One thing is clear, the Company known as “Thy Will Be Done” have done themselves proud for publicity and probably gained a lot of business, by using what I can only describe as “scare mongering” tactics.
