Applying for residentcy in Spain

Good afternoon.

We have purchased a property in Spain and intend to live there permanently from December 2020. We currently live in the UK. We are going to start the process asap to apply for residentcy using our Lawyers. Could anybody tell me how long this process should take.

Thank you any advice would be much appreciated.

Jim's guides - your complete guide to Spain

You have to apply for Residency in person so as soon as everything official is up and running your agent will need to get an appointment asap as rules change post 31st December. I think that as long as you can prove you have been here from before this date, especially food shopping, bills etc you will have some leeway.
When you say lawyer, is that a UK one? If it is I suspect a Spanish one would be better and a gestor even better (and cheaper) still and they may have the ability to make block bookings when appointments become available so more chance of getting an early one.

We won't be able to live there permanently until say the 1st week in December because of our work commitments.. I just hope with the lockdown we have enough time to put everything in place.

You're welcome. It will give you time to sort out a bank account which suits you as some will charge less for the bank transfer for your purchase but may have higher monthly charges and most Spanish banks have increased their charges and terms recently and most charge for using other bank's ATMs. Make sure you transfer the required amount monthly for the Residencia. It's always worth shopping around for bank accounts.

You will need to pay  Non Resident tax  in December 2021 for the pro-rata time in 2020 and you will become tax resident in Spain from 1st January 2021.

All the best for the future, you must be champing at the bit.

My purchase went through last week, so my house is legally mine. The purchase (using a Power of Attorney) went very smoothly, and now the everything else starts. At least I have accounts with two banks in Spain as a non resident to pay money into (my only income is my private pension).

My main worry is that completion on my UK house will go through before I am allowed to travel through France and Spain. This will make me homeless, as my travel to Spain is seen as non essential by France and Spain as I do not have a certificate of Residencia, even though my sole home will be in Spain.

Yes I can see the problem you might have. You can only hope that everyone in each country does their bit to keep this virus under control and we should see a end to this sooner rather than later. Fingers crossed

Try contacting the Spanish embassy in the UK, they may give you the go ahead should your UK house complete before borders are open. If you are driving down through France you would have to contact them as well.

Will do that if this situation happens. Foreign and Commonwealth office in UK say they can't do anything if I find myself in this situation.
