Hi everyone, I posted before looking for a reliable English speaking lawyer and received so many helpful replies. I am now asking for information/help regarding this PLusvalia tax which we have been told will be liable on the sale of our apartment.

We are not Tax residents in Spain but we want to sell our existing apt. and buy nearer to the beach as the evening walk back home is beginning to hurt and won't improve as time passes. We have been told that we must pay 5,900 Euro Plusvalia tax, but is this applicable when we are buying another property, is it just a local tax or national, does itapply to every property sale ???

Would appreciate any help/advice/ information

since hearing from Ray D I've researched the Plusvalia calculation for Torrevieja and I came up with 3900 Euro which is considerably less than we were quoted.

When we sold our apt last December our solicitor told us the Plusvalia tax was refundable. He also said it could take up to a year and that he would notify us when they received it he said many clients continually call him about this tax but he could not hurry up the refund but we would eventually receive because we sold at a big loss we are only now on contacting our solicitor finding that this is not the case. We were totally misled it seems that we now have to employ legal representation to try and claim this back for us the fee can actually amount to more than the refund. We understand this tax is illegal by spanish law but torrevieja town hall is making solicitors pay them this money. Why is local press not highlighting this total rip off scam. Jimmy.

Hi. Be very careful what advice you get on this subject plusvalia tax the lawyers and the town hall make money from this illegal tax when you sell at a loss.... total rip off. Jim
