Good morning all,

I am staying in a villa on the outskirts of Villena 01/08/2022 and was wondering what the current rules/laws are regarding BBQ's on private property. (I was informed that there was a ban with 100,000 euro fine :-(

I cant find anything conclusive and would appreciate any info/feedback

Never heard of that, We used to BBQ on our roof terrace and garden terrace every week and never had a problem. May be it is a new regulation after the fires that have swept through Spain this year to prevent more fires.

Hi Paul,

There's no nationwide law against lighting BBQs in private properties in Spain, so it's perfectly legal to do so.  However, you are not allowed to light BBQs in most of Spain's public spaces and there are strict laws (and penalties!) if you do so in the summer months.  Town Halls can make exceptions for dedicated picnic areas, but you may need a to obtain a licence from the Town Hall to use one.  The law also encompasses communities, such as apartments blocks, where you can light a BBQ on your private terrace or garden, but not in communal areas - if you're in any doubt, speak to your Community president or Town Hall.  Provided you have an adequate amount of private outdoor space, you can legally barbeque in Spain on your own property.

Getting away with something is not synonymous with it being lawful!

Hi Paul. We live just outside Villena near to Pena Rubia mountain. We have a bbq most weekends, used to be charcoal and now gas. Just make sure you put it out properly if it’s charcoal and your not near any trees. Enjoy 👍

I telephoned my Insurers and they say there is a ban in their Madrid area and they suggested I speak to the Orihuela Costa police (who don't speak english) or the Town Hall. I am worried as my property has Pine trees backing onto a property that may have barbeques.

Hi oliverd,

In the Community of Madrid, it's against the law to light a fire anywhere in the mountains, forests or rural areas any time between May and October.  It's also forbidden to use fire for cooking or heating, e.g. camp fires, throughout the year on forest lands and on non-urban lands located within 400m from the forest edge.  Similar laws were introduced last year by the regional government of Andalucia, because of the heightened risk of forest fires during the summer.  However, as I said in my previous response, there is no such nationwide law in Spain, and the regional laws impose these restrictions on public land.  To find out whether there are municipal regulations specific to private property in your area, you should speak to your Town Hall.
