Hi All,

First of all I would like to thank all of the great contributors on his forum it has been the the font of all knowledge and been a great help to us so far in our journey in Spain, i wish to dip into the well again please.

The senario is we bought a place nearly three years ago fully well knowing that things around residecy in Spain were likely to change after brexit, is it a possibility to spend more than the 183 days a year in spain and still keep our home in the uk without making the full transition to spain or go for full residecy before the endof 2020

Any thoughts would be appreciated.

If you want to spend more than 90 days out of 180 in Spain then as things stand residencia is your only option.

I wouldn't hold out too much hope of that changing any time in the foreseeable future.

I was asked today , what will happen if you over stay? Is it a fine, or will you get deported.

I have residencia so I haven't put much thought into the subject.

Hi Ray,

An extract from an "Update for non-residents" I posted this morning, states that monitoring of travel has already started:

"The UK’s Ambassador to Spain, Hugh Elliot, has confirmed that the British and Spanish authorities are aware of “the swallow issue”, and the matter is firmly on their radar BUT he cannot confirm that special rules will be put in place or be able to be agreed in the bilateral negotiations which are ongoing throughout this year and naturally which are yet to be concluded. He also stressed, contrary to what many “swallows” think and allege, that the UK and Spanish authorities are not only planning to monitor and enforce these systems, they are already talking to each other and doing so."

I know many of us thought that monitoring wouldn't start until after the transition period, i.e. 1st January 2021, but it appears from the British Consul's post that this isn't the case.
