Actually there is nothing wrong with that morally.The seller pays the commission, the agent gets the best price for the seller. It should be no other way.

Generally it is not Spanish Estate Agents that are the problem but Cowboy corrupt English Agents who would rip off their own dying Grandmother.

Should the have signed a pre buying agreement that states the price in the contract?

I ¨sold¨my house through an agent who advertises widely on the radio that his company appeared on the ´Sun, sea and selling house¨ TV program and claims to be a family of professionals - NOT!
He made a complete mess of the whole hose selling process which ended up with a lost sale and a further loss to me of 3 thousand euros.
Do you think that I got an apology or compensation? Think again!!
Their female lawyer, one to avoid at all costs, told me that she had sent me an email on the day of completion (!!!!!) to say that the buyer would not be attending the Abogado. And... they want 5 percent commission.....
You know who I mean - avoid them!

Although the seller pays a lot of money, we get the bad deal. I was told by an agent last month, sign exclusive contract, it goes on internet etc all stops pulled out for a sale. This is for 5%. For me that's 8k. Had 5 agents price the house, all in the same ball park. Went with this agent as seemed most professional and local. Within days had an offer. 20% below asking. Got quite bolishi when I said no. Wanted me to accept 35k lower than they priced it at. Lots of money, littlework.

Many Estate Agents ( LOL ) are charging between 5 and 7 %
" for sale "sign on house" Dependent on the location of property of course.......Mine's on the market..private sale, but with only half dozen people passing by in a week I"m having to resort to other methods. Villas.
I agree, Most of the UK estate agents in Spain are nothing more than Opportunistic SPIVS.
