Hi looking to sell our duplex in los palasios rojalos . The estate agent wants us to give him power of attorney.  Is this normal in Spain how do I know I can trust them . Thank you

I could understand giving your independent lawyer (absolutely nothing to do with estate agent) POA but I wouldn't be giving POA to the estate agent selling your property.

Be extremely careful. I personally witnessed a case where the seller would't see a penny, and there was no legal way to claim anything. Stay away., and NEVER hand in any original documents. Before signing any contract or agreement be sure you have fully understood what you sign - DO NOT TRUST any one and anything. There might be exceptions, I do not know any. Sorry to say this. Any POA should clearly be limited in time and task(s). You will be fully responsible of what the beneficiary commits or omits in your name.

Hi Margaret,

No, it is not normal to give your POA to an estate agent.  If you can't be in Spain for completion of the sale, you should give your POA to your INDEPENDENT lawyer, not one tied to the estate agent.

Kind regards,

Kim
