If you are looking at holiday lets then no one can legally let the property unless it has a Tourist License, although there are a few dodgy agents that will tell it is ok for them to do it - it's not! You will need to check that new Licenses are permitted on your community, and here is strict criteria you need to meet. Assuming the community allows new Licenses (most do) and that your property meets requirements then it is a 3 part process
First you need to obtain the Certificate of Compatibility from the Town Hall. This is basically permission to apply for the License. It will involve an application with supporting documents to Orihuela Costa Town Hall, which they take ages to process. I believe current waiting time is around 9 months, but might be longer. The supporting documents are certified copies of your NIE, your Passport, the deeds as proof of ownership, habitation certificate and if you have owned for more than a year they may ask for a copy of your last IBI receipt (often called suma). Current fee is approx €55.
Once you have that you can apply for the License itself. All done online to the offices for Tourism in Alicante. Your application form needs to be supported by the Certificate of Compatibility, NIE, passport, habitation cert, copy deeds and an EPC. The application itself is free and takes around 6-8 weeks currently.
You will then be issued with your License number and can start advertising. The License number is required to be included in all forms of promotion. The License will also state your permitted maximum number of guests. At this point you will need to obtain your login codes for registering your guests on arrival, buy your official plague, your official complaints forms and take out appropriate insurance.
You will need to decide if you wish to manage the rentals yourself with the services of a keyholding and cleaning company or hand it over to an agent. It depends how much of the rental you wish to retain and how much control you wish to have over who stays and when.
As a non-resident your tax is payable in Spain every quarter. If you are an EU resident it is 19% after allowable deductions but if a non-EU resident then is a 24% on gross rental.
