Rental problems: tenants stop paying rent after a few months

We have a lovely 2 bed flat in Rosa Leda behind the Village Inn.  We rent it on long term rents but all of our tenants seeem to move in and pay for a few months and then stop paying the rent. Is this the norm?  Holiday Homes in Catral manage the rentals for us

I would hope it's not the norm! You are using an agent and they should chase up any rental problems as they are being paid a fee to manage the rental. What do your agents say about it?

Is there anything in the contract that the renters signed about what happens if they don't pay the rent? 

This must happen occasionally and I would think that a good rental agent would have some sort of system in place to deal with it. The renters would obviously lose their deposit  so you should get some recompense there, which may help a little.

Maybe other members on here can tell you their experiences.

Thanks for your reply.  I haven't seen a copy of the rental agreemnt and at the moment we await a reply from our agents as to why the rent has not been paid and when it will be.  We have rented our apartmnet now for 7 years and each tenant has been the same. Unreliable.

Hi John,  Sorry to hear. Using simple logic either your tenants are ALL bad which is pretty unusual or your agent is systematically ripping you off.

Maybe go see them for that rental agreement and find out how much notice you have to give them. Meantime get recommendations for good agents and swap to one of them?

Thank you for yoour reply.  In the 6 years of renting our flat we have encountererd numerous bad tenants one of whom stole almost all our stuff apart from furniture.

The Tenant who has left today owes almost 2 months rent and used the rent to buy a Licence for her new hairdressing business in Catral so beware people of Catral who intend to rent to her.  I intend to persue the oustanding rent via our lawyer and consider our options.

Sounds awful! I assume you have changed your agents each time, if not I would be suspect of the agent dealing with these renters.

The legal system in Spain is notoriously slow. Things like this can take years and be costly, negating any financial redress.  It could be better to investigate what the agent was doing and why these things happened first. A good agent may have insurance in place as they are working for you and taking their fees from the rental.  Are you sure they are not keeping the rent?  Do you know others who have used these agents with no problems. Were they recommended to you?

Just a few thoughts.

Actually it's your agent that is unreliable. It wouldn't surprise me if they were collecting the rent and keeping it, telling you it hasn't been paid. You need to contact un abogado ( if your Spanish isn't fluent, go on the British embassy website to find a list of English speaking lawyers) to sort out your contract problems, it's not expensive and will save you in the long term. They will have local knowledge and point you in the direction of a reputable agent as well as sorting rental contracts.
