I guess paying tax

Illegals do not pay tax, that is the one way they will not catch them, but when they do they will get a tax  bill.

It could turn out to ne very lucrative for Spain, and costly for the illegals, who think they can stay under the radar!!!!!

I cannot understand why people who have been living in Spain didn't get their residencia last year at the latest. Anyone residing in Spain for over 6 months should be registered for tax in Spain. You cannot be resident in 2 countries. Last October I asked someone I know personally are you getting your residencia? They said No I'll just sneak in!!!! I replied I think you'll find you won't be able to next year. They go back to see family for a couple of weeks every 2-3 months. I said you'll be caught out as they will be checking at the border control. They are in Spain for much longer than they are back in the UK. They really believe they'll get away with it. If anyone is living in Spain in their own property or in a legal rented property, the authorities will have access to Bank, Suma and Utility records. If you don't do something to address the situation in the end you will be deported as you are illegally residing in Spain.

There have been so many posts on this topic and yet people still didn't do anything about it. They have been de-frauding the Spanish authorities many for years. Yet they seem surprized.

I agree entirely while we are spending money they will turn a blind eye.

But a friends solicitor chaired a meeting with the police and they said they will not be chasing 90 day dodgers now but will be next year.

They have not got enough police to worry about this.

Whether the police chase overstayers or not when the border agencies get their systems fully integrated people will be monitored in and out and thats when they will likely be caught.

The other check is now the Banks  they require all non- residents to update their Bank account details, they even want your national insurance number.

We couldn't access our online banking and last October we had to go into branch, (Banco Sabadell) when we were over. The woman who dealt with us said that British holiday home owners would be Third country nationals from the 1st of January and no longer an EU citizen and the rules are different. They even wanted our National insurance numbers. Extra checks are now being made. A friend has just had her Bank account frozen as she has been unable to get over to update her details. This is causing no end of problems.

It is so simple, these illegals are , FOOLS.  They have not understood the UK leaving the EU was not a simple matter like they were told, remember 'they need us more than we need them'.

Illegals in Spain thinking that while the UK have been a major source of money through house sales, and they will have to change or they will suffer are wrong, people in the business say it is Europeans from many countries that will fill the void.

I think there are many more ways in which illegals will be exposed than listed so far here.

In honestly they are 'cheats' and they will cheat any country they are in, best idea is for them to 'go unto where they came'.

If they have existed using the EHIC card, then they have been cheating Spain out of tax, and the set contribution for their health, they may not have declared their tax in the UK at the same time, Spain does not want them and it is a pity the UK has to accept them back.

Good honest immigrants should report abuses, be they friends or not.

I don’t think that’s correct you can have residency in more than one country maybe you are thinking about tax residency which is different.

It funny that the friends of Helenx who started this thread

and steve and jan who seemed to be pleased to be illegally in Spain,

have not given their reasons, against reason, why on earth the EU and Spain are going to change the rules to suit them.

I think we will wait a long time to hear, Oh perhaps thay have realised the folly and are packing up to LEAVE.

I don’t think that’s correct you can have residency in more than one country maybe you are thinking about tax residency which is different.

  1. Firstly, that person shall be deemed to be a resident of the State in which he has a permanent home at his disposal. The OECD Model Convention gives more priority to the “permanent” character of that dwelling than to the title it holds; Thus, the requirement would be met in both owned and rented homes. However, in the latter case, they can not have the character of permanent housing rented for holidays, short seasons, timeshare …
  2. If that person has permanent housing available to him / her in both countries, he / she will be considered a resident of the country in which his personal and economic relations are closer (center of vital interests). It is a question of fact, in which different circumstances will have to be examined to determine where the center of vital interests of the person is: social and family relations, work, cultural activities, politics … The comments of the MCOCDE offer further información. It is important, however, to look at personal circumstances rather than to any other thing, taking as an example the case of a person who owns a property in a country in which he has always resided, and that acquires another property in another State, but maintains the first. Thus maintaining the environment in which he lives with his family, where he has always worked … This, along with other factors, may be indicative that this person has maintained the center of vital interests in the first State.
Most people that live in Spain do not have a permanant home back in the UK. In most cases they sold up, lock, stock and barrel.
