In this case, remaining UK resident, you should not sign on the padron.

We had an appointment for the padrón but are not residents. 

We were told that they would write to the country where you are resident and inform them,  you are then deregistered. This has serious consequences such as health care. We backed out and refused the padrón. You have to pay a none resident tax every year anyway in Spain this covers the amount that the government would have given to the council.

 I have friends with a holiday home in La Marina, they used to live there but went back to UK because of medical problems. several years ago

 This week, while visiting, they have been able to get a new padron from the town hall & a 3month SIP from the salud   both available in La Marina!!

 I was more than surprised that they could get either as non residents.

As far as I know for temporary health/SIP card people do sign on the Padron but the Town Hall will remove you from the Register (depending on how efficient they are) after 3 months if you don't return with your TIE.

By signing on the Padron you are declaring that you are permanent resident and therefore subject to Spanish tax laws. The "deregistering" referred to above, I believe, refers to the fact that Spanish tax authorities will then notify your home country of this fact. This will then affect any payments in your home country including social welfare payments etc . eg cost of living allowances that you are receiving in your home country and will also affect your taxable income in Spain eg pensions, house sale proceeds and capital gains, ISA's etc. because you must then declare all your worldwide income/investments yearly to Spanish tax authorities. You are opening yourself up to what could be a massive can of worms in order to get no real benefit. When eventually caught you may be liable for fraud, non-filing and late filing charges, huge fines and possible jail in both jurisdictions
