I am looking to get a quote on building a bedroom plus ensuite on top of my home in Daya Nueva. If anyone can help I would appreciate it.

Talk to your Council first. The 2arquitecto municipal" will tell you what you can do and what not.

Hi, do you mean build this extra room on your roof terrace/solarium? If so I'd seek professional advice.

We've just bought a top floor apartment in Daya Nueva which on the roof terrace/solarium was a wooden pagoda with a tongue & groove fixed canopy for shade. Also the front terrace was closed off with glass doors making this a added bonus as it was used as another bedroom if needed.

However the solicitor acting on our behalf stated, that to get the habitation license both, the roof on the pagoda and the glass doors on the terrace had to be removed as this was breaking regulations. (All cost to the seller)

We've seen many apartments around Spain with the terraces boxed in with windows. So how are they getting away with it? 

I hope this helps as you might be asked to take it down in the future.

Thank you so much for replying.  I will definitely do my homework before anything goes up. Spanish law is so vague and it seems to be who you know that helps with these matters.

Yes you will need planning permission. It will come under Major Works Licence so you will need to get an Arquitect to draw up the plans and submit them to your local council.  If you are on a Community you will have to get permission first from the Community in writing to submit with your planning application. There is a very good firm of Architects which are recommended quite often on the local forums http://www.martinezdelacasa.com/office/contact.html

As for similar extensions on existing houses. It depends on when the works took place as there was an amnesty in the Comm Valenciana with a 2010 cut-off date. I don't know how this works when you request a current Habitacion Cert if you are selling. Brief overview on this link.
