I missed the post that was deleted - intrigued to know what it said!

Not a lot of value, nothing personal and by his own admission he had been drinking, quite heavily, lol.

It was a disgusting rant from a disillusioned poster who couldn't get things to go his way. Spain is well known for its paperwork and wanting everything presented in triplicate etc, etc. Anyone making an application for residency must learn to have the patience of a Saint, or it may drive you to drink and disillusionment.

Morning Peter, apology accepted. It looks like you had a very frustrating day which boiled over.
Buy your inhalers over the counter here before you go.

According to this, you cannot use your EHIC for NHS treatment in the UK as free NHS care is residency based and you are no longer a UK resident. You will have to use travel insurance.

Also, within the first 5 years of residency in Spain you are limited with the amount of time you can spend...

... outside of Spain. It is 6 months in any one year and a maximum of 12 months overall otherwise your residency will be cancelled.

Hi,

I knew you could spend 182 days a year out of Spain for the first 5 years if you got your residencia under the Withdrawal Agreement but never heard it mentioned that there was a maximum of 12 months within the 5 years.

I thought If #residencytie TIE is a temporary 5 year one then you can be absent for 6 months in any year (max 182 days). If TIE is a 10 year permanent one you can be absent from Spain for up to 5 years. If TIE granted via the Non Lucrative Visa route then you can only be absent for max 10 months over the first 5 years, one max period of 6 months allowed but only leaves you with another 4 months to be absent during the rest of those 5 years.

Article 162.2 of Royal Decree 557/2011 establishes the maximum period of absence allowed with those cards.

In order to know the maximum time you can be out of the country with a temporary residence, you must take into account two different conditions

  • Firstly, you must not be outside Spain for more than 6 months within a period of one year.
  • In the case of sporadic departures (in your first year in the country 1 month, in the second 3 months, etc.); the sum of these periods outside Spanish territory during the last 5 years may not exceed 1 year.

If you comply with these two requirements, you may keep your residence card and renew it (as long as you comply with all the other renewal requirements, which are different according to the type of residence).

Hi,

I've had the below information verified now so wanted to share this with the group..

For a temporary 5 year TIE you can spend up to max 6 months per year (182 days) away from Spain. With a 10 year permanent TIE you can spend up to 5 years away. The info seems to be mixed up with those via a visa route and not as benficiaries of the WA. For NLV TIEs they can only spend max 10 months away from Spain during first 5 years with just one block of 6 months
