Hi, We have owned a property in Campello for the last 19 years, small community of only 11 of us. The common areas of the property are not being kept in good order generally, the common areas are not being cleaned properly, the main stairs are being gradually taken over by residents and being used to dry the washing, this constitutes a fire hazard and an obstruction if needed to evacuate the building .  

We would like to notify the situation to an official Health and safety body for an inspection.

Can you help?

Hello

Firstly I think you should notify the president (if he isn't resident) and also your Administrators......they should be able to resolve the problem amicably  with the home owners without involving anyone else

Does the Community legally exist? is it registered? If so there are several ways in which you can try to oblige the community to provide essential maintenance and services, especially if a safety and health hazard is created. First, if conditions are as bad as you describe, you can report the situation to your local town hall, which is responsible for such standards, if they find faults, they are empowered to order the Comunidad de Propietarios  (joint ownership of common property) to make good. Second, You or your group of concerned owners can bring legal action against the other owners on the grounds  that their negligence causes prejudice to your property, lowering its value, even personal suffering, you will need a good Lawyer for this. Thirdly, you can go to court, charging the community with failure to maintain the property, again you will need a good Lawyer, the courts of law are not an appropriate arena for the do-it-yourselfer !!
