Employed:
ERTE is claimed by the employer for the employee. A the moment the employer pays the first 2 weeks wages and full months Social Security.
2 weeks Social Security will be refunded/credited to the employer at a later date. The employer then after 30 days makes a claim under ERTE.
The claim is prepared through a specialist employment lawyer at cost of 450€. The employee should provide their bank details as part of the claim.
Claims will not be submitted until the start of May. An employee should expect 70% of their monthly salary near the end of May.
Autónomo - Self Employed:
If you are autónomo and can demonstrate that your monthly income has reduced by more than 75% based on an average of the last 6 months.
You can make a request for Paro and Unemployment benefits. You won´t qualify straight away. This requires 1 month of lowered income.
The state of alarm has been extended until April. This means that you can apply for a Muta at the beginning of May.
You need to check with your gestoria/accountant for the benefit you will receive. I think at the moment you receive 70% benefits (650€) and continue to make your Social Security payment. The amount may have been updated to 950€ + Social Security. It´s under review. You will remain autónomo during the state of alarm.
At the end of this month/tax quarter you must pay your Social Security and 1st quarter tax. April Social Security payment is suspended and you should receive a credit/refund for 2 weeks of March.
The alternative is to cease trading and become unemployed. No guidance has yet been issued as to whether this is a good idea.
Check with your employer, accountant for current updates. The regulations have been amended several times.
