Planning Permission Timescales

Hi All,

We're currently in the process of finalising a plot of land for building purposes. We have narrowed it down to 2. One in La Romana and one in Barbarroja which falls under Orihuela

Our builder is familiar with La Romana and building permit times seem to be around 3 months. However he's not as familiar with Orihuela, partly as the Orihuela boundary falls into a very weird slit of land up through Albatera and up towards Barbarroja. He said he's heard of applications taking up to 2 years but that could be outdated.

The Barbarroja one is probably in the lead for me, but not enough to warrant waiting an extra 18 months.

Has anyone recently made any applications or has any idea on timescales?

Ask at the ayuntamiento, they will be able to tell you the exact timescale and if you’re lucky the licence will be ready for collection a couple of days before that date.

Alternatively a local architect will be able to give you a rough idea.

We are currently applying for planning consent on an extension. Not sure if it is different but the timescales we have are. Drawing plans approx 2 weeks. Submit to the school of architects for approval 2 weeks (these 2 stages confirmed as they have just been completed). Submit to local ayuntamiento and permission if successful is approximately 3 months (San Miguel de Salinas). Then you have 6 months to start the work and 18 months to complete.

Times may be different in other ayuntamientos.

Thanks. Orihuela is a bit of a trek away from where we are but the above sounds a little more hopeful vs 2 years. Still not entirely sure if it is the Orihuela town hall or not. I'd have thought Albatera would be closer and more relevant.

Just trying to get some information now as the info from the estate agents, don't line up at all with the paperwork/cadastral references, and apparently even though the plot contains a cave dwelling (mostly derelict), it's not included in the sale unless we pay extra. Not really sure how you sell a plot without something which resides on that plot!

It's probably because there will be no deeds for the cave house. There are lots of rural properties that have been there many many years that never had deeds.

Oh yeah, i get that, but i mean i don't get how she thinks she can sell it without the cave. I get that it would be harder to justify the cost without it officially being registered, and for mortgage purposes it would be difficult to get the full value unless it was registered (i accept banks would be unlikely to mortgage land)

She either needs to price the plot including the cave dwelling, or not sell. I don't see how she can offer the plot both with and without something which exists on the plot.

Presumably she is not selling the land 'without' the cave

 It will be that the cave probably does not exist on the deeds to the land. She cannot sell you something that legally does not exist. You could possibly insist that the cave dwelling be added to the cadastro before signing in the same way we have had to have some outbuildings added. There is also no guarantee that the dwelling will be added by the planning department.

But that doesn't explain why she's giving me 2 prices for the same plot.

It's tempted as whilst it's very cool and i've love a project for myself whilst the actual house is being built by professionals, i don't value it at €30k!

I'm trying to get the agents to speak with my agents. The main issues i'm having is the selling agents have 2 flaws

1 - They don't speak Spanish, and so rely on Google translate to convert from the seller to me. This doesn't always make sense. They don't then seem to question things that don't make sense, just blindly pass it on.

2 - They don't understand the technicalities/rules of selling "land" and what is involved, and so similar to the above, they just pass on what they're told rather questioning it.
