Demolition next door

Our new neighbours are gutting the house behind us. They are not removing the rubble but spreading it all over the garden the place looks like a bomb site. They are obviously not professional builders how can we find out if what they are doing is legal? Is a solicitor the best way to go?

Hello       

Have you spoken to your neighbours to ask what their plans are?    You could also contact the Ayuntamiento/Local Police but perhaps you should take photos & get some information from the neighbours first --they might have permits for the work  and be doing everything legally.

Other posters, who have had experience of this,  might have more advise for you

My  first  port of call  would  be  Community  President.  They  should have  permission  from Community. 

Then a friendly  call   in person   that is if  they speak  English.  Enquiry  as to there plans. If they  are infringe  on  your rights  let them know nicely  and see there  reactions.  If  you get an  unsatisfactory  response  contact  local  Council   inform them it looks like a  serious  health hazard  and building  looks  unsafe. I  would  try and  bring  some good neighbours  along  for moral  support  and you might get a good  response  in large numbers.  But either way  it sounds  like  your new neighbours  have broken  your  trust  and not  good  going  forward

I can't see how any trust has been broken or undermined, just someone renovating a dwelling not in a manner understood by a neighbour. 

Additionally, I suggest that the low key, individual enquiry of the neighbours would be likely elicit more cooperation and information than going mob handed.

Normally  would  one  not approach  the neighbour  🙄  and  inform them  of up coming   Demolition  and Construction  work would shortly  be commencing. 

That  in itself  say something.  When no communication  was  forth  coming.  It  a  matter of  respect  which  in  my reading  of comment posted say their is none on  behalf  of  people  conducting  the Construction.   So  trust is  fractured  to say the least.

Agree...BUT There seems to be little respect for others anywhere these days.

I understand that it might be a matter of courtesy to inform neighbours of imminent work, depending on your culture. When I was undertaking work on my house I told the neighbours in advance only to be met with confusion. Why, they wondered, would someone tell someone else that they are doing work in their house? They simply didn’t comprehend. Perhaps the neighbour thinks similarly. 

I still don't understand any breach of trust, nor "respect".

In  my  experience  of  over 42 years  in Construction   that  event of  neighbours  been confused  would be in minority.  Not that all of my time  in  Construction  was  in  renovation  small  properties. We would always  advise  Client  to advise  or consult with them in  case we may need to infringe  on their  property  for a short period of time

I do not see anything wrong here from the neighbors perspective only the "nosy" neighbor; ie. original poster.

Are they disturbing you during siesta? on a Domingo? Late at night? If not, do not look that way until they are finished..

I can't see any problem either, it's their right to do work to their property if they have all the permissions. My neighbours in my apartment block never inform anyone when work is to be done, why should they!!
