We want to rent ours out, and have been told that you have to have a up to date certificate.

As anybody been told, if because there habitation certificate has expired they will have to apply for a new one if they want to rent.

Hi Brian,
This article about Habitation Certificates from my tax advisors, Abaco, may help:
Although it says you only need to get a new certificate, if the previous one has expired, should you want to sell your property, it also mentions that you need it in order to change utilities into the new owner's name. As this would also need to be done for a tenant, it seems logical that you would also need a current certificate to rent out your property.
If you have doubts, perhaps you could call a couple of other letting agents in Spain and ask them whether you need a current Habitation Certificate in order to let your property?

Hi sorry for butting In but does anyone know how long it takes to obtain the habitation certificate because my solicitor applied for it in November , and I am trying to sell at the moment and don’t want any potential sale to be held up by this , thank you

I have been told 3 weeks, we will see, just applied for mine.

Thank you , so I have waited 4 months now ? I’m not sure my solicitor is doing her job then ? And I’m not over there to do anything about it. Any one have any advice on this , thank you.

I had the energy certificate done for a house here. Yes What a joke, the recommendation at the end was to make mods costing an estimated 14K Euros!!!, My total heating each year had been a max of 3 Gas bottles, 48 Euros It would take an awfully long time to recoup 14000 euros especially if I saved 2 gas bottles per year.. My present house is great max heating Heat pump PA 50Euros,Summer cooling 3 months about 150Euros. Energy cert 6k to Spend. Energy certificates here are a farce, as you suggested, How about an Bedouin tent energy cert. They must be glad they don't have European regs in Africa!
BTW in Italy you must have your A/C filters on your indoor unit cleaned by a licensed techy every 2 years or you can be fined.
