Just read the most horrendous story about an elderly couple who have lived in Spain for 15 years and own an apartment in Torremolinos. 

Apparently they went home for a 3 week holiday at Easter and returned to find the locks changed on their door and a large family now living there.  They could hear noises in the apartment so knocked on the door which was duly opened by a woman, who stated it was her place. The couple contacted the police who asked to see their deeds, which they shown and it was confirmed they were indeed the owners. The police then spoke to a woman and a man at the property who stated they had rented the property from someone in the street but could not produce any documentation etc..to show this. The couple were informed by the police that they will have to find a lawyer to take this family to court to get them out of their property.  The latest is, this poor couple are now living in a hostel while they try and raise the funds to do this and they are paying for the services still by direct debit. The family are still living there.

I am always going on at my husband about taking our security grills off our doors but from now on he won't hear a peep out of me. Is this quite common in Spain???

Wait for them to go out and you change the locks. Period. .it works . Get in there chuck  their stuff out in black bin bags change the locks. 

Then if Police arrive say they went of their own accord. They are not going to argue.

Linda - in an ideal world, your method of evicting would be ideal....

However, how many owners would be in a position to sit patiently in wait, (possibly for days/weeks on end) waiting for the squatters to go out for the day, and what locksmith would also be able to sit and wait for an instruction to get in and change the locks at a minutes notice - as they will have other jobs to do, and likely to be based in their shop or office, away from the property....

It’s a sad state of affairs when this sort of action takes place, there are a lot of despicable people around who will do anything to get their hands on something that belongs to others....makes me sick in the stomach at the thought of it happening to me....
