Hi There All,

I’m hoping for clarification here!! I’ll try and keep this short

On a recent visit to my home in Villamartin, first for a year!! I travelled by boat to Santander arrived 30th September  and had my passport stamped on entry. On exit at Alicante Airport 16th the boarding gate was prior to passport control and I assumed they would stamp passport. Airport official I asked to get passport stamped told me I did not need to, that policia local will know!! I seemed to be the only one that asked!!

Now I’ve just recently heard of people on news feeds being accused of overstaying due to not having exit stamp, I fortunately kept all my boarding passes on phone, flight info etc and locator form information. 

I’ve tried calling Spanish embassy, no reply, and I’m returning in December for a winter break and don’t want a problem on arrival, or to find I’ve used 60 days of my 90 instead of 16!!! 

Any help would be much appreciated.

Hello Alistair,

 I am really interested to see if anyone else has had an issue with this. The casual response from the airport official would worry me, other border control guards on different days could  interpret things very differently... good that you've kept all relevant exit paperwork.

 Can you contact anyone at the airport to ask your question?

If they stamp your passport coming in, insist on having it stamped on the way out. It will always be you that will end up with a problem.

I will, thanks for your post, but no reply at Alicante and all embassy’s no answer, I’m putting it down to red day, will try tomorrow, easy jet been helpful and in process of acquiring original boarding card for Spanish consulate, failing that I’ll fly back at weekend and will probably have a confrontation with passport control as according to my passport I’m still there!!! If they can’t stamp me out, why would I want/need another entry one!!! A headache I could have done without!! I’ll keep you posted

I did insist kenneth, and probably the only one !! Please read my post in full!!!! They insisted otherwise!!! I’d have been better handcuffing my self to the railings😂 anyway a headache I could do without, hopefully resolve this through embassy failing that I’ll fly back!! I’ve still 60 days left and if I’m “still there” why would I need another entry stamp!!! I’ll post my results for future

You can insist till your blue in the face as we did on Saturday night. It got us no where!

My husband as far as they are concerned is still in Spain, I have an Irish passport so I didnt need one.

We did not go through any scanners either as they gates were long before scanners and the ones close by were not in use.

Hi Alistair,

I also read the report of the woman who was accused of being an over-stayer.  The crucial evidence she needed, as far as the Spanish Consulate were concerned, was the boarding card for the return journey where Spanish border control had not stamped her passport at departure; unfortunately, she hadn´t retained it.  As you say you have the boarding card from your previous return journey, I would carry that with your on your next trip, in case you´re challenged.

There seems to be a lot of confusion at Spanish border control - UK citizens who are Spanish residents should not have their passports stamped, non-residents should have them stamped.  The Spanish government has confirmed this, but it doesn´t seem to be applied consistently on the ground.

Surely their is a presumption of innocent until proven guilty here ? And as you are re entering that proved you left !

Also as the spouse of an Irish national you are allowed to stay for 90 days leave for one day then return
