Good morning!

My wife and I are in the process of buying an apartment in Villamartin. Completion looks like being mid-October. Before I ask anything can I say that this forum is an absolute goldmine of information and tips- you really are a very helpful bunch!!

Our plan is to visit several times a year, rather than make the break from the UK. At least, that’s the plan at the moment.

If we own a property, are we allowed legally to clock up more than 90 days worth of time in Spain? My understanding of the Residencia is that this is a permanent transfer from UK tax duristiction to Spain. Does not quite fit in with our thoughts at the present time. 

Can anybody advise?

If you are using your property as a holiday home you can stay 183 days a year and be classed as non residents, you will be liable to pay non residents tax, nothing to worry about, it is due in December for the previous year, so in December 2019 you will pay from your date of purchase to the end of December 2018, probably around 5€ each.

Residencia and fiscal residency are different matters.

Up to 90 days doesn't require you to do anything. Over 90 days and you have to apply for a residency certificate.

183 days or more in one calendar year and you become a fiscal resident, at which point tax is due here and not in the UK.

We’ve just st had our non residents in ax through and it is €34 each

Sorry..noticed a few typing errors in my post. Should read we have just had our non residents tax through and its €34 each

I presume that is for a full year, if you read my previous post the person had only completed their purchase and I was commenting on a small part of the year.

We completed on our quad house in Playa Flamenca on 30th November 2017 for family use as a holiday home our solicitor has informed us that our liability for non residents tax due this December is €880 (€440 each) just wondering how this is calculated? and looking at posts here if this sun is correct many thanks

If the cadastral value has been updated since 1994, then tax is based on 1.1% of that value (shown on the SUMA bill for IBI).

I think the tax rate is 19%, but I'm not certain.

Your solicitor is probably charging you at least 100-150€ to do it for you, it is straightforward to do it yourself filling in the forms printing them and taking them to the bank to pay. If you are not confident about that look on Google for Spanish Tax Forms Ltd, English based but you send them your details they complete the forms send them back to you by email and you just have to print them and take to the bank, they charge around 30£.
