"I answered a advertisement on the estate agents site. Should I pay?"

By looking on their site you were for all intents and purposes asking them to find you a property and the fact that they happened to have a suitable one already on the books can't be used as a excuse to not pay their fees.

Personally I've never either rented or rented out a property in Spain - or anywhere - but I have to say that I would have expected agents fees to be down to a landlord and not a prospective tenant but maybe that's the norm here I don't know.

One thing is for certain though, agents can't work for free so one party is going to have to pay.

You could look at another way, if a tenant is not paying the fees then a landlord might well put the rent up to cover them which in this case would make it €650/mth instead of €600 and you'd be paying them anyway.

Nonsense.' Finders Fee' is illegal !

It's the landlords responsibly to pay any fees.

This is the legal situation re finders fees etc. It is not legal to ask the tenant   it is the landlords responsibly to pay any legal fees as it should be .

Does this include short term rentals? My agreement was going to be for 11 months.

The property I am viewing tomorrow is a winter let of 7 months. No finders fee for this property.

Thank you in anticipation.

Not so. Iris illegal to charge the tenant fees.

See you my previous reply for link, or just Google it, which anyone needing this important information should be doing in any event.

If you check my post I was referring to property purchase.

Thank you for all your comments they have been really helpful.

Today I have enquired about a property, and asked the estate agent if he charged a finders fee. He told me “Certainly not, the owner pays the fees”

I now feel more confident with my property search.

I believe it applies to both unless of course you specifically instruct an agent & agree fee

Hi

I have found a lovely rental property in Santiago de la Ribera. The agent asks for:

A months PCM: 600 euros + bills.

1 month holding deposit.Finding agency fees: 600 euros.
I did not instruct the estate agent to find me a property. So why do I need to pay the agent a fee? I answered a advertisement on the estate agents site. Should I pay?

Just try to bypass greedy agents. It's not illegal (yet) to charge a finders fee but not officially legal. It could come under unfair contracts and thus is a grey area. Best to look at alt. sources such as Facebook to deal with the owners directly.

It is the landlords responsibly for any fees not the tenant.

Please see the link on previous message about this.

It is not legal for the Agent to ask for this.

Thee are many people in FB doing this in Spain,  often they are not the Agents but individuals  who  find tenants/buyers & then claim the addiditional fee for themselves.
