Hi,

I have received a cash offer for my parents' apartment in Almoradi.

The buyers already have appointed a lawyer to proceed with the purchase.

I have all the documentation as my parents brought it home when they relocated.

Do I need to appoint a lawyer as well as a notary?

Legal fees for just handling a sale would not be a huge amount and would be the best insurance against no hitches.  If you are not fluent in Spanish, or not 100% sure you understand all the possible hold-ups and complications that can arise during a sale, then why take the risk?    The buyer's solicitor works for the buyer, they are not there to help you or protect your interests as you are not their client.  The Notary is there to check everything is legal when the documents are signed, he/she cannot advice you.  Do you fully understand taxes payable too?

I would not deal with a lawyer representing interests which could be contrary to yours. Take the original purchase deed to a notary of your choice and do not accept new or other conditions brought up by the buyer. Be sure you have the money before putting your signature. No checks or drafts. You, the seller, are liable to pay a special tax called "Impuesto sobre el incremento del valor de los terrenos", your Ayuntamiento will tell you how much that will be.

I have had a quote from an English lawyer for 850 euro which seems reasonable and they will take care of everything :)
