Renting your home

We recently bought a property , we don’t want to rent out to anyone we don’t know, just our family and some close friends, we only want costs for this, ie enough to pay the bills.

It has not got a tourist license, but we have been told it doesn’t need one if renting to friends or family, but we have also been told we need one and could get fined thousands , which one is right, I’ve look on the internet and it does seem to say we don’t need a license, but we also don’t want to get in trouble.

U are just the sort of person we are looking for we are moving to Spain next week but to my partners place in Galicia we will be looking for a rental in Jan and Feb as it's a bit nippy up there ,advertise on here we are definitely interested and have just talked to a friend who's parents do same in mijas ,advertise on every social media site and u will be happy 🤗

I think you'll find that, if you are taking money of any kind, you are renting, & that is illegal & not allowed. Friends & family are expected to stay with out charge, (so not renting )-- making that acceptable & no TL required.

Send a PM to forum member Davebev1 who knows all there is to know about Tourist Licences & requirements & he can confirm what I'm saying , or perhaps explain things better than I can

Thankyou , so as long as money is not exchanging hands it’s fine for friends and family to stay , looks like some of my family and close friends are going to have some cheap holidays 😂

The law is very clear, if you receive a financial payment for use of the property then you require a Tourist License, must register the guests and pay tax on the rental.  Family and friends can use your property entirely free of charge if you do not have a License, but even a payment to cover utilities is classed as renting.  If you are a non-EU resident then the tax is a straight 24% of the gross rental payment.  Fines are huge so really not worth the risk of letting illegally.  You would also be invalidating your house insurance as a specialist policy is required for renting.  Should there be an incident your family/friends are also not covered by their own travel insurance as renting illegally.  Even the community's insurance can be compromised.

Both you and the owner would be breaking the law by renting an unlicensed property.  It is not permitted to advertise unlicensed properties in Valencia region, let alone actually rent them out.  Your suggestion that they advertise on social media and ignore the law is not a good idea - unless you are happy to pay their fine.  Under our region's regulations the Tourist License number must be included in all ads, even social media.  Reputable advertising pages won't accept ads without the License number and on-line portals will not do so as they can be fined for facilitating an advert for an illegal let.  I am not saying people don't do it, they do unfortunately, but advocating some knowingly breaks the law and puts both themselves and the renter in a precarious position is not responsible of you.  Remember unlicensed means uninsured.
