House Insurance

I wondered if anyone can help on this matter. My apartment was flooded during the recent heavy rain and it now needs a new roof on the solarium. I have buildings and contents insurance but, the insurance company will not pay out on the roof, just the interior. I am sure if it was in England the insurance might pay out on both. Can anyone shed any light on this matter or is it just how it works in Spain??

Have they not explained why they have not  agreed to pay for your solarium repair?

If your apartment is in a block the community may have insurance that covers your roof damage.

Also it is the roof of the building, in Spanish terrado, techo or tejado. Solarium is just a word used locally in this context, by marketing people.

Hi Lizzy,

I first heard of this in the floods of 2019.  The general rule of insurance companies then was that water which comes up, i.e. flooding, is covered, but water that comes down, i.e. rain, is not covered, because insured parties are liable for maintaining our roofs, balconies, etc. in good order.  It is a peculiar stance though because, as you say, they'll pay for the internal damage - you'd think they'd either accept liabililty for all of it, or reject all of it.  

Home owners' insurance is usually sold as a combined policy, covering rebuilding costs and the contents, so you need to check to what extent the structure is insured.  Good luck!

They must have given you a reason why they will not consider the repairs to your solarium.  Presumably a perito inspected on behalf of the insurers ?  He or she would be in a position to comment on whether or not it was a maintenance issue.  Damage as a result of ingress of water would be covered however.  No to the comment that if it was in the UK they would pay out on both.  I am an ex UK underwriter. Hello Lizzy, 

For insurance here in Spain, building and contents are normally all on one policy (unless you don't want to insure one of the said parts).

Regarding the claim, I do agree somewhat with KIMMY11, your insurance will cover you for the damage done INSIDE your home, however, for the roof or "tejado" the water didn't damage the roof it was probably through no maintaining the roof correctly (so water proofing it, fixing the tiles if they are damaged, etc). 
Please note that insurance is for ACCIDENTS and will not pay out for poor maintanance - (if it did cover it, everyone would just leave their home in the state that it is and claim from the insurance company).

However, this is speaking without knowlage of what the expert has said, what your insurance covers and if the roof is community or privately owened. (If its community, you can get them to fix it (on good terms or legally), bear in mind that the insurance company might not fix your home until the "origin" of the damages have been fixed - so the roof).
