The law states clearly that if a payment is being made for a property for tourism or leisure purposes then a License is required. Well aware there are still people letting on the black market.

To clarify, if family are using the property for free then they are not renting it, just staying for free. Anyone can lt family, or friends, stay in their property for free.

I don't think anyone has suggested that Brits are the only ones ignoring the law. But if people don't report unlicensed lets then they will carry on getting away with it. As a renter I would want to know the property is legal and insured - unlicensed means illegal, uninsured and leaves the renter at risk.

Quite honestly all the discussion around whether or not have a license seems a bit passive-aggressive. It sounds like you just want to get back at them. In reality, if they have a license - are you ok with the noise? Probably not. I’d check with the community administrator if they have contact details, and then try to contact owners to let them know of the problem. They may not even know there’s a problem. If they don’t react - then yes, it’s appropriate to complain formally to the autho

I have tried to notify Guardia Civil but they said they did not speak English, seemed to me they are not really bothered to check these licences.

I cannot use my property due constant noise from the apartment above during the night. I want to know if all that goes legally at least.

Could anybody advise, please?

You register the guests on arrival on the Hospederias website - that is the law.  The site is run by the police.  Due to change to a new website, supposedly later this year, (but they said that last year too!)

Elle was pointing out that guests must be registered on arrival, not with the local police, they won't be interested.  But your community administrators should be reporting the illegal let and contacting the owners about the noise nuisance.  

You can check a License on the national register as well - find by address using datos Basicos or by the VT number using Signatura.  Not licensed then illegal to let as a holiday rental.  https://www.turisme.gva.es/datosabiertos/recursos-turisticos/viviendas-turisticas/
