Advice needed re SIP

Hi all, my husband and I are Irish and we got our Residencia last year. He got his permanent SIP card immediately as he has an S1 (he's on a pension) I had to take out private health insurance because I'm not eligible for an S1 yet. We had an appointment this week with Social Security to apply for me to be added (piggy back) on my husbands SIP and get my own. I was refused on the grounds that I'm not mentioned on his S1 as a family member. I phoned the health board in Ireland to see can I be added to his S1 but they said no, because I'm not a dependent or old enough (I'm 57). My question: has anyone piggy backed onto their spouses SIP and got their own permanent SIP and if so how did you do it? Any advice would be appreciated

Yes, some 8 years ago I Piggybacked on my wife's SIP.  After about 3 years I was entitled to get my own through the S1. 

You should have been added to your husband's S1 forms when he first applied, I don't know if you can "just add" your name retrospectively but as you are his wife you are obviously a dependant. 

It's well worth persevering with the health department in Ireland.

It is my understanding the issuing Health Authority in Ireland is wrong in the information given to you, providing Ireland is the responsible country for your health cover. For example, your husband's S1 was issued by the relevant health authority in Ireland. Presumably you have a marriage certificate to prove the relationship. It is just unfortunate you didn't get your name placed as a dependant on the original S1 as this would have saved you money from the outset. I have attached a link at the end of this text, which will take you to the Official EU website 'Your Europe'. There is a heading 'Pensioner' and one of the bullet points reads:

  • If you do not receive a pension or any other income from the country where you live: you and your family will receive medical treatment in the country where you live if you would be entitled to medical treatment in the country that pays your pension.

I would contact HSE Overseas Section on 01 6201816 again and explain you want your name added to your husbands S1 as a dependant. Should they refuse, request their determination in writing. You can then use this information to appeal against the decision if you still think it is wrong.

I would also contact the Irish Embassy in Madrid and explain your predicament. It is best to put it in writing by email. I have used the Embassy in the past for similar issues and have found them extremely helpful. I would not recommend either writing or calling at the Consulate in Alicante as it is an Honorary Consulate and will simply pass your query to Madrid. You can use this link to make contact:

Hi 

I have piggybacked my spouse's S1 for around ten years now, even though we're not married. We made the same initial mistake i.e. we didn't ask for my name to be included as a dependent.

I subsequently rang the relevant department (in Newcastle, I am British) and the bloke asked me if I had any access to healthcare. I said no, and he immediately said "ok, I'll send another S1 to your spouse which will include your name". Excellent!

Perhaps you should ring your health people again - you'll probably speak to a different person, and maybe get a different answer!

I am piggy backing off my husband. When he applied he asked for mine as a dependent at the same time. I think they wanted my NI number and details of my last employment. However we both received our own individual S1 forms so sorted out our SIP cards at the same time.
